These Terms of Use govern your access to and use of EverAfter,
including the mobile application, website, features and related
services.
EverAfter is developed and operated by Andrei Albu, an
independent developer based in Romania.
By creating an EverAfter account, accessing the service or using
any EverAfter feature, you agree to these Terms. If you do not
agree to these Terms, you should not use EverAfter.
EverAfter is an event-planning service designed to help users
organize weddings, birthdays, baby showers and corporate events.
Features may differ depending on event type, platform, region,
account status and whether the user has an active Premium
entitlement.
EverAfter may introduce, modify, improve, replace or discontinue
features over time where reasonably necessary for technical,
product, legal or operational reasons.
3
Eligibility and your account
EverAfter is intended for adult users who are legally capable of
creating and managing an account and entering into agreements
relating to the service.
You are responsible for providing accurate account information
and for maintaining the confidentiality and security of your
credentials.
You are responsible for activity carried out through your
account unless the activity occurred because of circumstances
for which you are not legally responsible.
If you believe your account has been compromised, you should
contact EverAfter as soon as reasonably possible.
4
Your events and content
You remain responsible for the information, files and other
content that you enter, create or upload through EverAfter.
You retain ownership of content that you create through the
service. By using EverAfter, you permit the service to process
and store that content only as reasonably necessary to provide
the features you request.
You must not upload or enter content that is unlawful,
fraudulent, abusive, defamatory, infringing, malicious or that
you do not have the right to use.
5
Guest and third-party information
EverAfter allows organizers to enter information relating to
invited guests and other people involved in an event.
You are responsible for ensuring that you have an appropriate
legal basis or permission, where required, to enter and use that
information.
You should only store information that is reasonably necessary
for event planning and should avoid unnecessary sensitive,
confidential or private information.
Certain EverAfter features may require an active Premium
subscription or other qualifying entitlement.
Available plans, prices, billing periods, introductory offers
and applicable taxes are displayed through the relevant app
store before a purchase is confirmed.
EverAfter currently offers subscription products through
supported app-store platforms. Availability and pricing may
differ by platform, region or currency.
EverAfter uses RevenueCat to assist with purchase validation,
subscription status and access to Premium features. RevenueCat
does not replace the applicable app store as the payment
processor.
7
Free trials and introductory offers
EverAfter may offer free trials, promotional pricing or other
introductory offers to eligible users.
The duration and conditions of an offer are displayed before the
user confirms the subscription. Eligibility may depend on the
rules and purchase history maintained by the applicable app
store.
Unless cancelled before the end of a free trial or promotional
period where applicable, the subscription may automatically
convert to a paid subscription at the price shown at the time of
purchase.
8
Renewal and cancellation
Premium subscriptions may renew automatically unless cancelled
in accordance with the rules of the applicable app store.
Users can manage or cancel an active subscription through the
account or subscription settings provided by Google Play or
Apple App Store, depending on where the subscription was
purchased.
Deleting the EverAfter application or deleting an EverAfter
account does not automatically cancel an active app-store
subscription.
Cancellation generally prevents future renewal but does not
normally remove access already paid for during the current
subscription period, subject to the applicable app-store rules
and mandatory consumer law.
Payments for digital subscriptions and purchases are processed
through the applicable app store. EverAfter does not directly
process or store full payment-card information for these
transactions.
Refund requests are generally handled according to the rules,
procedures and policies of the platform through which the
purchase was made.
Nothing in these Terms removes or limits any refund or other
remedy that must be provided under applicable mandatory consumer
law.
Where supported, eligible purchases and Premium entitlements may
be restored using the app-store account associated with the
original purchase.
Restore functionality depends on information provided by the
applicable app store and subscription-management infrastructure.
You must use EverAfter lawfully and in a manner that does not
harm other users, the service or third parties.
You must not attempt to bypass Premium restrictions, interfere
with security controls, reverse engineer protected parts of the
service except where applicable law expressly permits it, gain
unauthorized access to another account, introduce malicious
software, overload infrastructure or use EverAfter for
fraudulent or unlawful purposes.
Automated access, scraping or abuse that materially interferes
with EverAfter may be restricted where reasonably necessary to
protect the service.
The EverAfter software, application design, visual identity,
branding, monogram, logos, original interface elements and other
proprietary materials belong to Andrei Albu or their applicable
rights holders unless otherwise stated.
These Terms grant you only a limited, personal, non-exclusive,
non-transferable and revocable right to use EverAfter for its
intended purpose.
No ownership rights in EverAfter's intellectual property are
transferred to you by using the service.
13
Service availability and changes
EverAfter aims to provide a reliable service, but uninterrupted
or error-free availability cannot be guaranteed.
Features may be temporarily unavailable because of maintenance,
updates, technical failures, third-party service interruptions,
security requirements or other operational reasons.
EverAfter may modify features where reasonably necessary while
taking applicable consumer rights into account.
14
Planning information and decisions
EverAfter is an organizational and event-planning tool.
Information, estimates, calculations, suggestions or planning
outputs provided through EverAfter are not a substitute for
professional legal, financial, medical, safety or other
regulated professional advice.
Users remain responsible for decisions relating to their events,
vendors, venues, budgets, guests and other arrangements.
EverAfter relies on third-party services to provide parts of its
functionality, including Google Firebase, Google Sign-In, Sign
in with Apple, Google Play, Apple App Store and RevenueCat where
applicable.
Third-party services may be governed by their own terms,
policies and availability conditions.
EverAfter is not responsible for independent services, websites
or systems that are outside its reasonable control, subject to
any responsibility that cannot lawfully be excluded.
16
Account suspension or termination
Access to an account may be restricted, suspended or terminated
where reasonably necessary to protect users or the service,
investigate suspected misuse, respond to security threats or
comply with applicable law.
Where appropriate and reasonably possible, EverAfter may provide
notice or an opportunity to address the relevant issue.
Users may request account deletion through the functionality
provided by EverAfter or by following the instructions on the
EverAfter Delete Account page.
17
Liability and mandatory consumer rights
EverAfter is provided on an "as available" basis and may depend
on third-party systems, internet connectivity, app stores and
cloud infrastructure.
To the maximum extent permitted by applicable law, EverAfter is
not responsible for indirect losses arising solely from events
outside its reasonable control or from decisions made by users
in organizing their events.
Nothing in these Terms excludes or limits liability where doing
so would be prohibited by applicable law.
Nothing in these Terms limits mandatory rights or remedies
available to consumers under Romanian, European Union or other
applicable consumer-protection law.
The processing of personal information through EverAfter is
described in the
EverAfter Privacy Policy
.
The Privacy Policy forms an important part of understanding how
EverAfter operates and how information is handled.
19
Changes to these Terms
These Terms may be updated when EverAfter changes, new features
or service providers are introduced, or legal and regulatory
requirements evolve.
The "Last updated" date shown at the top of this page will be
revised when these Terms are materially updated.
Where required by applicable law, users may be given additional
notice of material changes.
20
Governing law and consumer rights
These Terms are governed by Romanian law, without depriving
consumers of mandatory protections that apply under the law of
their country of residence where such protections cannot
lawfully be excluded.
Nothing in these Terms prevents a consumer from exercising
rights or remedies available under mandatory consumer-protection
legislation.
Every celebration starts here.
